She said:
  • 7 APR 1891 in Buena Vista, she married George A Lighthizer (middle letter may be transcription error)
  • he was already married
  • also, he treated her badly . . .
  • striking, choking, threat with butcher knife
  • chased her 1/2 mile with butcher knife
  • after knife event he vacated, but visited occassionaly to abuse her
  • also threatened James E King on 10 APR 1893, who was working for her farm and residing at her home. He did attack Mr King, a severe fight, and difficult ejection of defendant
  • no children from marriage
  • he is able bodied and draws a $12 pension from US Gov
  • she has small farm and cannot afford divorce
  • she supports 2 children from prior marriage
  • asks for divorce/annulment, support, court costs, and restraining order
He said:
  • she and King had it in for him
  • he could no longer live with her
  • he sent her money from his Marathon job in a sawmill. (several amounts detailed)
  • in MAR 1893 he returned, lived with her, and provided for her and farm
  • that King cohabitated with her during his absense and he believes several years prior to his marriage to her
  • never struck, choked, or knifed
  • King affadavit is false
  • (no mention of bigamy charge)
Apparently George defaulted and she won.
Granted divorce and return to Mary E Smith name
